1. Agreement to Terms

By accessing or using Poster Face Designs ("Service"), operated at posterfacedesigns.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Poster Face Designs provides a platform for creating personalized photo products including:

• Big Head Posters: Large-format posters with face cutouts on themed backgrounds
• Photo Calendars: Custom 12-month wall calendars with user photos
• Photo Cards: Personalized greeting cards (5×7")
• Custom Cards: Fully customizable cards with AI-generated backgrounds
• Business Cards: Professional business cards with multiple design templates
• Face Banners: Large-format banners with face cutouts

Products may be downloaded as digital PDF files or sent to participating store locations for printing. Certain features use AI-powered tools as described in Section 4A.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity.

4. User Content

4.1 Your Rights

You retain ownership of photos and content you upload ("User Content"). By uploading content, you grant us a limited license to:

• Process and store your content to provide the Service
• Create products based on your content
• Display previews of your products within the Service

4.2 Content Restrictions

You agree NOT to upload content that:

• Infringes on intellectual property rights (copyrights, trademarks, or publicity rights) of others
• Contains illegal, harmful, or offensive material
• Depicts minors in inappropriate situations
• Contains malware or harmful code
• Violates any applicable laws or regulations

4.3 Your Responsibility for Uploaded Content

You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for any content you upload to the Service, including but not limited to photographs, logos, artwork, and images of identifiable individuals.

You are solely responsible for ensuring your content does not infringe any third-party copyrights, trademarks, publicity rights, or other intellectual property rights. This includes, but is not limited to:

• Photographs of celebrities, athletes, or public figures
• Sports team logos, mascots, or branded imagery
• Corporate logos, brand marks, or trademarked designs
• Stock photos or images obtained from the internet without proper licensing
• Artwork, illustrations, or designs created by others

Poster Face Designs does not review, verify, or monitor user-uploaded content for copyright or trademark compliance. We assume no liability for any intellectual property infringement resulting from content you upload, create, print, or distribute using our Service.

4.4 Content Removal

Uploaded photos are automatically deleted 30 days after order completion. Generated PDFs are deleted after 90 days.

4A. AI-Generated Content

4A.1 AI Background Generation

Certain products (Custom Cards, Business Cards, Banners) offer AI-powered background generation. By using this feature, you understand and agree that:

• AI-generated images are created using third-party AI services (currently Replicate/FLUX)
• Text prompts you provide are sent to these third-party AI services for processing
• Generated images are stored in your account gallery and may be deleted by you at any time
• We apply content safety filters to prompts and generated images; content deemed inappropriate will be blocked
• AI generation is subject to availability of third-party services and may occasionally be unavailable

4A.2 AI Content Restrictions

You agree NOT to use AI generation features to create content that:

• Is sexually explicit, violent, or depicts harmful activities
• Infringes on the intellectual property or likeness rights of others
• Generates content depicting real individuals without their consent
• Attempts to bypass content safety filters through prompt manipulation
• Violates the acceptable use policies of our AI service providers

4A.3 AI Credits

AI background generation uses a credit-based system. Credits may be included with subscription plans or purchased separately. AI credits are non-refundable and non-transferable. Unused credits do not roll over between billing periods unless otherwise specified.

5. Purchases and Payments

5.1 Pricing

All prices are displayed in US dollars and are subject to change without notice. Prices at the time of purchase will be honored.

5.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

5.3 Subscriptions

Subscription plans provide access to product creation tools. Current plans include:

• Design Tools: Access to all design products (Big Heads, Calendars, Photo Cards, Custom Cards, Business Cards, Banners)
• Imposition Tool: Professional PDF imposition and nesting for print production
• Everything Bundle: All Design Tools plus Imposition Tool at a discounted rate

Subscriptions automatically renew unless canceled. You may cancel at any time from your account settings. Cancellations take effect at the end of the current billing period. No refunds for partial months or unused time.

5.4 Credits

Some products use a credit system for pay-per-use access. Credits are non-refundable and non-transferable unless otherwise specified.

5.5 Refunds

Due to the personalized nature of our products:

• Digital Downloads: Refunds available within 7 days if the product is defective due to a technical error on our end
• Store Printing: Contact the store location for printing-related issues
• Subscriptions: Monthly subscriptions are refundable within 48 hours of initial purchase if no downloads have been made. Annual subscriptions are refundable within 14 days if fewer than 5 downloads have been made. No refunds for renewals.
• Credits: Unused credits may be refunded within 30 days of purchase
• AI Credits: Non-refundable once generation has been attempted

Refunds will NOT be issued for user error (wrong photo, typos, etc.), dissatisfaction with results after download, or change of mind. To request a refund, contact us with your account email, transaction date, and reason.

6. Store Partner Program

If you operate as a Store Partner:

• You are responsible for printing and delivering products to customers
• You must maintain quality standards for printed products
• Customer complaints about print quality are your responsibility
• You agree to display official signage and QR codes

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, and content (excluding User Content), is owned by Poster Face Designs and protected by copyright, trademark, and other laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or authorized business purposes.

7.3 Restrictions

You may not:

• Copy, modify, or distribute our software or content
• Reverse engineer or attempt to extract source code
• Use automated systems to access the Service
• Remove copyright or proprietary notices

8. Disclaimers

We do not warrant that:

• The Service will be uninterrupted or error-free
• Results will meet your expectations
• Defects will be corrected

9. Limitation of Liability

To the maximum extent permitted by law, Poster Face Designs shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Poster Face Designs from any claims arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Sumner County, Tennessee, in accordance with the American Arbitration Association's rules. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15. DMCA / Copyright Infringement

We respect intellectual property rights. If you believe your copyrighted work has been infringed, please contact us with: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief, a statement of accuracy under penalty of perjury, and your physical or electronic signature.
